The charges against Omar Khadr
CBC News quotes Khadr's lawyer:
But Glazier, the former military officer, adds, "the law of war does not criminalize throwing a hand grenade or shooting at soldiers; that is, in fact, what militaries around the world are called upon to do."
I've long wondered about that.

I would suggest that it is not the act, but the person conducting the act that makes it a crime. If the person is not a lawful combatant (as defined in the Geneva Conventions and international law) then civilian law can apply.
